Authority to act
The Council is authorised to act as property factor for your block as the Council has historically provided several services for your block through ‘custom and practice’.
It should be noted that the Council’s powers as property factor are no greater that the powers of the individual owners.
Those parts of the block which come under our factoring service are as laid out in the Property Schedule for your block in Appendix A. The Property Schedule includes a summary of the common parts of the block as set out in your title deeds or in the Tenements (Scotland) Act 2004, see below.
Our authority to act includes the management of
- core services, for example, lift testing, see to section 6
- repair and maintenance service jobs where they fall below the pre-authorised cost limit, for example, fixing a common door lock
- emergency repairs, for example a property fault causing damage to the building fabric or a risk to public health and safety and must be dealt with immediately
- utilities and utility bills for common parts and services, included in Core Services, where appropriate
- planned maintenance and major projects, after a majority vote has been achieved to proceed with work, for example, renewal of roof coverings or communal painting scheme. NB improvements would require all owners to agree.
